Welcome to Mobie OnEdu LMS, a learning experience platform provided by Mobie Ltd. (“Mobie”, “we”, “us”, or “our”). These Terms of Service (“Terms”) govern your access to and use of the OnEdu platform, including all features, services, content, and tools (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use the Service.

1. Use of the Service

You may use the Service only in accordance with these Terms and all applicable laws and regulations. You must be at least 13 years of age or have parental/guardian consent to use the Service.

Users include:

• Students, Teachers, and Administrators affiliated with an educational institution;
• Organizations or corporate clients using the platform for professional learning or onboarding;
• Other authorized users as defined in a licensing agreement with Mobie.

2. User Accounts and Responsibilities

• You are responsible for maintaining the confidentiality of your account and login credentials.
• You agree not to share your account or give others access to your account.
• You must immediately notify Mobie of any unauthorized use or breach of security.
• You agree not to use the Service for any unlawful or harmful purposes, including the upload of malicious software, illegal content, or harassment of others.

3. Intellectual Property

All content, software, technology, and materials within the OnEdu LMS platform (except where otherwise noted) are the property of Mobie Ltd. or its licensors and are protected by intellectual property laws.

• Users retain ownership of any content they create or upload.
• By uploading content, you grant Mobie a non-exclusive license to use it within the scope of the platform’s functionality.

4. Data Privacy and Security

Our Data Privacy and Protection Policy governs how we collect, use, and protect your data. By using the Service, you agree to the data handling practices described therein.

Mobie complies with:

• GDPR (General Data Protection Regulation)
• Relevant national data protection laws
• Secure cloud infrastructure practices

5. Availability and Support

Mobie strives to ensure the Service is available 24/7, but does not guarantee uninterrupted availability. From time to time, we may perform scheduled maintenance or updates.

Technical support is available to clients during standard business hours, unless otherwise agreed.

6. Modifications to the Service

Mobie reserves the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We may also update these Terms periodically. Continued use of the Service constitutes your acceptance of any changes.

7. Termination

We reserve the right to suspend or terminate access to the Service for users who violate these Terms or applicable laws.

Upon termination:

• Your right to use the platform ends immediately.
• Your data may be deleted or retained per our data retention policy and contractual obligations.

8. Limitation of Liability

To the maximum extent permitted by law, Mobie shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of your use of the Service.

9. Governing Law

These Terms are governed by the laws of Finland. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kuopio, Finland, unless otherwise agreed.

4. Data Retention and Ownership

• User data is retained only as long as necessary to fulfill the educational services.
• Educational institutions remain the owners of their data.
• Upon request or contract termination, all user data can be securely deleted.

5. Third-Party Services

If any third-party services (e.g., video conferencing tools or external content providers) are used within the LMS, Mobie ensures:

• A clear data processing agreement (DPA) is in place.
• All services meet equivalent data protection standards.

6. Accessibility and Fair Use

Mobie OnEdu follows the WCAG 2.1 (Web Content Accessibility Guidelines) to ensure that the platform is accessible to all users, including those with disabilities.
